AAP/MRG Website Terms of Use
1. Application of the Terms of Use
These terms (Terms) together with any additional terms, conditions and disclaimers contained in the applicable Subscriber Agreement between you and the Operator (as defined in item 2 below) governing your use of the Service (as that expression is defined in the applicable Subscriber Agreement) (Subscriber Agreement) form the conditions of supply of content on and use and access to the Website operated by the Operator and the Service.
Your use of the Website and the Service constitutes your acceptance of these Terms.
2. The Website
The Website is operated by Australian Associated Press Pty Ltd and its related bodies corporate (collectively AAP) or The Media Research Group Pty Ltd (MRG), as applicable (Operator).
3. Use of Content included on the Website
The copyright in the information provided through the Service and Website is either owned by or licensed to Australian Associated Press Pty Ltd or The Media Research Group Pty Ltd (see item 6 below). You may not use this information for any purpose or in any medium or format unless you or your organisation have a valid and current Subscriber Agreement in place with the Operator and strictly adhere to the terms of such agreement.
For the avoidance of doubt, any information contained in the Service and the Website (including, without limitation, edited, abridged or rewritten versions of this information) can not be republished, redistributed or redisseminated in any form without Operator's written permission. The above prohibitions include framing, linking, posting to newsgroups and any other form of copying.
4. Accuracy of content
The Website, the Service and content included on them are published for information purposes only without assuming a duty of care. The Operator is not in the business of providing professional advice, and gives no warranty, guarantee or other representation about the accuracy of the information or images contained on the Website or in the Service. The Operator is not liable for errors, omissions in, delays or interruptions to or cessation of the Website and/or the Service through negligence or otherwise.
5. Limitation of liability
All express or implied representations, conditions, warranties and terms relating to the Service, the Website or these Terms not contained in these Terms are excluded from these Terms to the extent permitted by law.
Nothing in these Terms exclude, restrict or modify any condition, warranty, right or remedy implied or imposed by any statute or regulation if it cannot lawfully be excluded, restricted or modified. If the law, including the Trade Practices Act 1974 (Cth) (as amended) or any similar legislation, implies or imposes a non-excludable condition or warranty which can be limited, the liability of the Operator to you for breach of that condition or warranty will be limited - as the Operator determines to:
(a) supplying the service again; or
(b) paying for the cost of supplying the service again.
The Operator is not liable for any indirect, consequential, special or punitive loss or damage in respect of the Service or the Website or any act or omission on its part in relation to its obligations under these Terms or for any payments to third parties, loss of revenue, loss of profits, loss of goodwill or data however caused, whether or not:
(a) such loss or damage was foreseeable or contemplated by either party; or
(b) the Operator is advised of the possibility of such loss or damage.
In the event that the Operator breaches any provision of these Terms, the Operator’s liability will in all circumstances be limited to the amount specified in the applicable Subscriber Agreement.
6. Copyright
Unless otherwise stated, the Operator reserves all copyright in the content and design of the Website and the information contained in the Service. The Operator owns all such copyright or uses it under licence or applicable law.
You may view the Website, the Service and their content using your web browser subject to the conditions set out in these Terms and the applicable Subscriber Agreement.
7. Trade marks
The Website and the Service include registered and unregistered trade marks, including but not limited to the word AAP, the AAP logo, MEDIANET, AAP NEWSCENTRE, AAP NEWSCLIP, AAP ECLIPS, AAP eClips and AUSTRALIAN ASSOCIATED PRESS. You may not use any of the Operator's trade marks or the names 'Australian Associated Press Pty Ltd', 'Australian Associated Press', ‘Media Research Group’ or ‘The Media Research Group’ without first obtaining the Operator's prior written consent.
8. Privacy
The Operator will collect and use personal information in accordance with its privacy policy which is found here.
9. Applicable law
These Terms will be governed and construed in accordance with the laws of the state of New South Wales, Australia.
